Page 1 1) Make sure each question has been answered completely. 2) Don’t forget to include application type, new, change of location or change of ownership. 3) License type; 4) License fees $100.00 each (except used and wholesale combined $100.00); License fees not required until application has been considered and approved. 5) Ownership information; Name of Individual(s) and percentage(s) held. 6) Complete physical address of business. PO Box may also be indicated on application for mailing purposes, if PO Box is in same county of business. 7) Business phone number; Business phone must be working prior to inspection; 8) If multiple businesses are operated on or from the same location, physical lot separation must be installed prior to inspection. Page 2, 2(a) Financial Statements (Bond may be required prior to licensing) 1) Make sure each question has been answered completely. 2) Zero’s (0’s) should be placed in the amount column of each item if no other figure applies. 3) If there are no business debts, a separate statement should be included with application attesting to that fact (indicated on top of page 2). 4) Each owner applicant must provide a separate personal financial statement (one enclosed per application). 5) Don’t forget to sign and date. 6) An incomplete financial statement will not be considered. Page 3 Photographs 1) Attach requested photos to form (fitting the width of page) and/or attach photos to additional pages. 2) Photograph of permanent business sign; Sign should be permanent, matching the name of business exactly as it appears on Articles or Assumed Name, with 9-inch letters, visible from the nearest roadway, installed at time of submission of application. 3) Please DO NOT send digital photograph of what the sign will look like when installed. Sign must be present at time of inspection (inspection occurs after MVC receives application). Page 4, 4(a) and 5,5 (a) Owner Data Forms 1) A Data Form must be completed for each person who has an ownership interest in this business. 2) If more than two (2) owners, make additional copies. 3) Answer each question completely. 4) Complete Date of Birth and Social Security number required. 5) Question F pertains to criminal convictions, misdemeanor or felony. This question must be answered correctly. We conduct a criminal history check with Administrative Office of the Courts. (A conviction without disclosing on application could result in denial, or revocation of dealer license.) 6) Criminal convictions do not necessarily constitute denial. A letter of explanation of conviction(s) should be submitted with the data sheet to be considered at meeting. Letters of Recommendation from community leaders may be requested. 7) Don’t forget to sign form; 8) Have form notarized. 9) Photograph of owner attached to 4(a), 5(a) with employment history. Page 6 Drawing of Premises – Statement 1) Overview drawing of premises should include the location of the sales office, vehicle display area, and business sign in relation with the nearest roadway. 2) Dimensions of business office and display area required on drawing. 3) Page 6, #12 is a statement that must be read and signed, Notary required. Page 7, 7(a), (b) Certificate of Assumed Name forms 1) Complete page 7 and file with Business County Clerk if SOLEPROPRIETOR ownership, only if business name does not include owner last name. 2) Complete 7(a) if business is owned by more than one person. Partnerships are required to file form with the Kentucky Secretary of State and the Business County Clerk (file with Secretary of State first, then County Clerk). 3) Corporations and Limited Liability Companies are required to file page 7(a) with the Kentucky Secretary of State and the Business County Clerk, if “Inc” or “LLC” is not indicated on business sign. 4) 7(b) are filing instructions for the Kentucky Secretary of State. Page 8 Lease 1) If property not owned by dealer applicant, a lease agreement must be acquired signed by Lessee and Lessor. 2) Lease requires notarization; 3) Sublease if property is leased from someone other than property owner. Page 9 Zoning Statement 1) Application will not be considered without zoning statement. 2) Zoning Statement must be signed by appropriate zoning official, zoning administrator or County Judge Executive. 3) The zoning statement should be completed, including the address, by zoning administrator. Page 10 Restricted / Automotive Recycling Dealer Application 1) This form should only be completed if applying for the Restricted / Automotive Recycling dealer license. 2) The local zoning administrator must complete this form, indicating if the property meets the qualifying exemptions (#1) from the Kentucky Department of Highways Salvage Yard Permit Division. 3) This license type may require, in addition to this form, a Kentucky Department of Highways Salvage Yard Permit (#2). 4) Document must include physical address of business. 5) Document must be signed and dated by administrator. Additional items required: 1) Salesperson license application(s) (not available on-line). These forms will be sent to you by mail, to the physical address of the business or alternate PO Box in same business city. 2) Verification of Garage Liability Insurance not required until application has been considered and approved. Insurance must be in the form of a Binder or Certificate from the Underwriting Company. Proof of Insurance Cards NOT ACCEPTED. Insurance must be filed exactly in the name of business as indicated on application, business sign and/or Assumed Name form. Physical address of business must be included on Insurance Certificate. 3) Copy of Articles of Incorporation or Articles of Organization must be filed with the Kentucky Secretary of States office, include filed copies with application. 4) A Corporation or LLC existing in another state must file for Certificate of Authority with the Kentucky Secretary of State. Filed copy must be returned with application. 5) Manufacturer Authorization; “NEW” CAR / MOTORCYCLE DEALERS ONLY; The manufacturer must give you written permission for the sale of new cars / motorcycles. This document must include ownership approval, correct business name and physical location. 6) The application should include when returned a processing fee of $40.00 and a $10.00 fee for each owner having interest in this business. 7) License fees are not required until application has been considered and approved.
